What is Agency?
A relationship in which one person is authorized to represent the interests of another in business dealings with a third party.
In Real Estate, there are typically 3 types of Agency Relationships: |
| Buyer’s Agent |
| A real estate agent who represents a Buyer is a real estate transaction. A Buyer’s Agent has the fiduciary duties of loyalty, obedience, disclosure, confidentiality, and accounting in dealings with their client, the Buyer. |
| Seller’s Agent (also known as the Listing Agent) |
| A real estate agent who represents a Seller in a real estate transaction. Agency is generally created through a listing agreement. A Seller’s Agent has the fiduciary duties of loyalty, obedience, disclosure, confidentiality, and accounting in dealings with their client, the Seller. |
| Limited Representative (also known as a Dual Agent) |
A real estate agent who acts on behalf of both the Seller and Buyer in a real estate transaction through one or more of the salespeople within a real estate firm. Prior informed, written consent from both the Buyer and Seller is required.
The duties owed to the clients (Buyer and Seller) are limited and there will be conflicts in the duties of loyalty, disclosure and confidentiality. Disclosure of confidential information may be made only with written authorization. |
